Served as court-appointed Special Litigation Counsel to a Chapter 7 Trustee in the United States Bankruptcy Court for the Northern District of Texas, while simultaneously representing the estate’s principal creditors, in a multi-year adversary proceeding asserting fraudulent-transfer and related claims arising from the diversion of a skilled nursing facility’s operating revenues. Structured and prosecuted the litigation under a court-approved litigation funding agreement permitting the joint pursuit of interrelated estate and non-estate claims, and guided the matter through extensive forensic discovery, dispositive-motion practice, and a negotiated resolution that included the Trustee’s court-approved sale of remaining estate claims to the funding creditor.
Defended a major U.S. financial institution through the MDL class action challenging overdraft fee practices in the Southern District of Florida, examining each named plaintiff and the pivotal plaintiff expert at deposition.
